北京市三所医院医疗告知制度比较研究

The comparison of the informing rules among three hospitals in Beijing

目的:通过分析、比较北京市3所医院告知制度情况,探讨医疗机构告知制度建设中存在的问题。方法:采用内容分析法分析北京市3所医院告知制度。结果:我国有关病人知情权规定散见于多种法律政策文件中;3所医院均存在国家要求告知而医院却没有相应制度、比较重视易引起医患纠纷与国家监管严格的特殊告知、制度制定与实际不符、有的制度过于繁琐等情况。结论:国家应就病人权利进行专门立法,医疗机构要重视病人所有知情权的保护,制度制定要全面、具体、条理清晰。

Objective：To explore the problems existed in developing the informing rules in hospitals.Methods：The content-analyzing-method was used to analyze the informing rules in three hospitals in Beijing.Results：In our country,the regulations regarding the patient＇s right of knowing are distributing stated in several literatures of laws or policies.There are no according hospital regulations in these three hospitals although they have the required information by the govemment.Relatively,special information lists,such as those regarding medical dispute or under govemment＇s strict supervision,attract more attention in hospitals.In addition,there are some problems existing in the current situation,e.g.inconsistence between regulation and reality,and prolix statements,etc.Conclusions：The govemment should set up a Law about patients right of knowing,and develop a comprebensive,detailed and well organized regulation .
