对公安机关参与行政联合执法的理性思考--兼论警察行政协助法律制度的构建

Rational Thoughts on Police's Participation In Cross-agency Collaboration——Focusing on building the Administration Assisting System

在落实依法治国和依法行政原则的宏观背景下,鉴于公安机关具有处理紧急危害和行使强制力的能力,迫于警察权滥用的现实考虑,以法律制度规范公安机关参与行政联合执法活动显得极为迫切。本文针对我国行政联合执法的有关现实情况,从组织、程序和责任三个层面来构建警察行政协助法律制度,通过界定公安机关在行政联合执法中的辅助地位,限制公安机关的参与范围,规范公安机关的参与时机与程序,可以起到规范行政联合执法与规范警察权的双重功效,促进警察权的理性运作。

In the context of ruling by law, the police organs have the forcible power to deal with emergency. However, owing to the realistic concern about the abuse of this power, it is urgent for us to use laws to regulate police＇s participation in cross-agency collabration. This paper focuses on the institutional construction of police＇s participation. The author considers that the construction should consist of three parts organization, procedure and responsibility. Based on defining the assisting status of police organs in public management, the author suggests to limit their participation behavior and regulate their participation time and procedures, so as to promote the rational operation of police power.
