Study on the Legal System of Pest Risk Analysis

随着全球国际贸易的不断发展,环境污染与破坏问题也相继而至。为应对国际贸易带来的环境问题,有害生物风险分析应运而生。以往关于有害生物风险分析的研究大多限于技术与标准,鲜有将其法律化、制度化的考量。本文即在阐明有害生物风险分析概念和操作规程等基本问题的基础上,借鉴国内外立法与实践经验,探寻有害生物风险分析法律制度建立和完善的具体措施。本文第一部分阐释了有害生物风险分析法律制度的基本问题,第二部分分析了我国有害生物风险分析的机构与立法,第三部分提出了完善我国有害生物风险分析法律制度的具体措施。以期为有害生物风险分析的立法与实践提供参考。

There have been more environmental problems brought by the development of the international trade, such as pollutions and damages to the environment. Most of the researches concerning to PRA are limited to scientific skills and standards, few of them analyses the problems in a legal or systematic way. This paper will start by theory a- nalysis, on the basis of concepts and scientific procedures, consider the specific legal and practical experiences both at home and abroad, make out the suggestions for consummating the Legal System of Pest Risk Analysis. The text is mainly consisting of five sections. The first section of the paper has a general analysis for Legal System of Pest Risk Analysis. The second section analyses the institution and legislation in China. The final section raises suggestions for consummating the Legal System of Pest Risk Analysis according to its confronted problems, which is written as reference for the practice and the legislations.
