摘要
转化犯是我国刑法所独有的名称,是对犯罪行为发生转变后罪数形态的概括。转化犯的提出拓展了刑法罪数形态的理论,对司法实践有一定的指导意义。但我国有关转化犯的刑事立法存在一定的缺陷,需加以完善。
Transformation crime is used only in our country. It is the summary of criminal forms about criminality transformed. The statement of transformed crime has developed theory of criminal forms; it has certain guiding sense to judicial practice. But some criminal legislation of transformed crime has certain flaw and need consummation.
