摘要
心理现象在当代刑法的结构与运作中无疑扮演着举足轻重的角色,对于成立犯罪并进而衡量犯罪、裁量刑罚发挥着不可或缺的功能性作用。由于世界各国立法对此规定的抽象性,因此围绕心理现象之刑法机能检讨问题,学术界存在激烈的争论。此争论有助于刑法理论的明晰,进而有助于我国刑事法律制度的完善。
The psychological structure plays a great role in the structure and execution of the modem criminal law. Because the pluralism that the countries all over the world legislate in the abstract, there is fierce dispute in the academia. This dispute is really es- sential, ones that contribute to legal theory of the criminal law.
