略论网络著作权侵权及法律保护

On Encroachment of Copyright on Internet and Law Protection

随着网络技术的不断发展,著作权保护的范围和内容不断扩大和深化,由此引发的著作权侵权纠纷时有发生。我国目前关于著作权保护的法律、法规相对滞后。文章从网络著作权侵权的概念、特征入手,分析了网络著作权侵权行为及法律责任,阐述了我国网络著作权立法的概况及其不足之处,从立法建议、完善著作权集体管理制度等方面着重探讨了网络著作权的法律保护。

With the development of network technology, the scope and content of copyright protection has been deepened on a larger scale. As a result, disputes of copyright encroachment frequently come into being. To make things worse, China＇ s laws and regulations against copyright encroachment is relatively behind the times. This article starts from the cocept and features of copyright encroachment, analyzes the encroachment behaviors on Internet, points out the weakness of copyright protection in China in the field of laws and regualtions, and finally elaborates on the measures that can be used to tackle problems of copyright encroachment. The measures include making concerning laws, further enforcing the collective management system of copyright and so on.
