Status and role of appraisal conclusion of medical malpractice in civil proceedings

通过对本地区各级人民法院民庭法官调查问卷汇总分析,了解人民法院对现行医疗事故技术鉴定制度的评价,指出现行医疗事故技术鉴定结论在民事诉讼中的地位和作用,正确认识医疗事故技术鉴定和法医司法鉴定的关系,充分发挥医疗事故鉴定在民事诉讼中的作用,更好地服务于审判工作。

By analyzing the result of some questionnaires, the article discussed the evaluation of the judicial departments about appraisal conclusion of medical malpractice and the status and role in civil proceedings. The author suggested that the relation between medical malpractice identification and forensic identification should be understood correctly and make good use of medical malpractice identification to help judging of civil proceedings.
