“硬法”软化及“软法”硬化现象的法社会学解析——基于中国义务教育法治中的案例 被引量:12

摘要 功能、结构理论视角下的"硬法"和"软法",是社会成员行为创造的结果;二者在一定条件下能够相互转化。义务教育法治中也存在着"硬法"和"软法",甚至伴生了"硬法"软化和"软法"硬化的不良现象。在教育法治进程中,必须既要使"硬法"真正硬起来,彰显"硬法"的法制权威,又要规范和培育"软法",发挥"软法"的柔性治理功能;同时防止"软法"硬化和"硬法"软化,使二者协调起来,实现"软硬之治",促进社会有效、有序、和谐发展。 According to system theory and functional Intensity, " laws" can be divided into "hard laws" and "soft laws". They are the outcome of social members' creativity and can be mutually transformed. In the implementation of the compulsory education law in China, there is an abnormal phenomenon that some hard laws are softening while some soft laws are hardening. Hard laws and soft laws should be correctly implemented and coordinated so that they can promote effective and harmonious social development.
