领事保护问题及其对策探析

On the Problems of Consular Protection and the Solutions

新形势下我国领事保护制度面临的主要问题:部分人员对领事保护的重要意义认识不够,工作中还存在一定的畏难情绪;目前我国既熟悉国际法,又熟悉相关国家国内法律的专门人才还不多;相关多边或双边协定数量有限,进一步加大了领事保护的困难;由于我国国籍政策而引发的对海外华人保护困难的问题等。对此提出对策及建议:加强国际司法合作和国内立法;加强领事保护能力建设,最大程度地保护我国侨民利益;加强我国的综合国力,尤其是军事能力。

At present the major problems confronting the consular protections are as follows： the inadequate realization of the importance of the consular protections and the fear of difficulties on part of some people ; the lack of personnel who are both well-informed both in international laws and the laws of the countries related ; the limitation of multi-lateral and bilateral agreements signed with the other countries; the difficulties to protect the overseas Chinese due to the policy of nationalities of our countries. The measures or suggestions made to solve the problems are as follows ： strengthen the international judicial cooperation and the lawmaking at home ; enhance the capability of consular protection ; protect the interests of the emigrants to the best of our ability ; reinforce the comprehensive national strength, especially the military power.
