摘要
结合物权法、债权法理论,对贷款购房与运动员人力资本产权界定进行了研究。论述了贷款购房这一经济活动给予运动员人力资本产权界定的启示:产权界定不等同于财产所有权归属的界定,而是各方权利具体内容的界定;出资者在不拥有财产所有权的情况下,同样可以取得收益。运动员人力资本产权界定的原则不应是"谁投资、谁所有",而应是"谁投资,谁受益";区分财产所有权与债权,是实现运动员商业活动中多方合作和产权界定的基础;建立契约机制,是实现运动员人力资本产权分配的一个重要途径。研究还提出了结合具体的体育事务、根据相关法律法规研究体育产权的建议。
In this paper, on the basis of Property Law and theory of creditors, the purchasing house with loans and defining of human capital property rights of athletes were discussed. It indicated that, first, defining property rights is not equivalent to defining ownership of property ownership, but defining specific content of rights for each side. Second, investors without property ownership also can get the same benefits. Defining property rights of athletes" human capital should not follow the principle of "who invested, who owned", but "who invested, who got benefit". Third, distinction between ownership and property claims is the foundation to define property rights of athletes and to build up cooperation in various commercial activities. Establishment of contractual mechanism is an important way to obtain capital earning of athletes" human rights. The authors also suggested according laws and regulations and relating concrete sports affairs to carry out sport property study.
