我国著作权集体管理组织的性质分析

Analysis of Characteristic of Collective Management for Copyright in China

著作权集体管理是现代社会中实现著作权人和邻接权人权利的一种重要途径。在现有立法和实践考察基础上,对著作权集体管理组织的民间社团性、垄断性、非营利性和会员加入自愿性加以详细论述;并对著作权集体管理组织在网络环境中运用时的性质特征演变予以了一定分析,在新的环境中,著作权集体管理组织应沿袭原有垄断性和非营利性,并应允许公权力的干涉而为半官方的社会团体,同时对自愿予以一定限制。

The collective management of copyright is one of the essential ways for the authors to realize their copyrights. This thesis discusses the civil partnership, monopolity, non-profitability, and voluntarility of copyright collective management with consideration of latest legislation and practical situation. It analyzes the evolvement of characteristics of copyright collective management in information network and concludes that voluntarility of copyright should be restricted to make it be a semi-official organization interfered by public right in present situation.
