生态文明与转基因生物安全监管法律制度研究评述

Commentary on the legal system supervision to environment caused by genetically modified organisms under the ecological civilization background

转基因生物产业化给人类社会带来福祉的同时,也给我们赖以生存的生态环境造成了不确定的环境风险。目前学界围绕转基因生物环境安全监管法律问题,在监管理论基础、国外监管法制实践和国内对策研究方面取得了一定的进展,但相当一部分研究还停留在政策解读和经验总结层面。在生态文明视野下,转基因生物环境安全问题作为一个重大的理论和实践课题,迫切需要基础理论研究、法律制度供给和制度运行环境各系统间的沟通和互动来加以深化和落实。

While the biological industrialization of the genetically modified organisms brings happiness to human society, causes the uncertain environmental risk to ecological environment that we depend on for existence too. Academic circles, focusing on the legal question of safety supervision to the biologial environment of transgenosis at present, have made certain research progress on the theoretical foundation of supervision, foreign supervise legal system practise and domestic countermeasure research, but quite a lot of researches still stay at understanding and summarizing the experience in the aspect of the policy. Under the ecological civilization vision, as a great theory and practice subject, the biological safety problem of environment of the transgenosis needs basic theoretical research urgently, needs to be deepened and implemented with the communication and interdynamic among every system of running environment of system that the legal system is supplied.
