知识产权质押有关法律问题初探

知识产权质押是以可转让的知识产权为标的而设定质权对债权予以担保的法律制度。作为将知识产权资本化的重要模式之一,知识产权质押对促进资本流通、保障交易安全、激励自主创新具有重要意义。但是,我国现行的知识产权质押担保制度尚不健全,理论研究不够深入,市场主体及金融机构缺乏实际操作经验,知识产权的担保融资功能还未能充分发挥。鉴于此,需要对知识产权质押的有关法律问题进行研究,并研究我国知识产权质押制度体系存在的问题和解决的途径,以探索一条补充和完善我国质押担保法律制度和实践规则的道路。

Mortgage of intellectual property is a legal system which set pledge to protect credit by taking transferable intellectual property as object. As one of the most important models of intellectual property capitalization, mortgage on intellectual property plays a great role in promoting capital circulation, ensuring transaction security and encouraging independent innovation. However. the current mortgage on intellectual property system in China is not perfect, the theory research is not protound, the operating experiences of market object and financial institution is deficient, and then the secured financing function of intellectual property can＇ t fully exert. So some legal problems of mortgage on intellectual property as well as the problems existed in the system need to be researched and the solving way need to be found so as to explore an road of supplementing and perfecting China＇ s pledge and guarantee legal system and practice rules.
