Rule of Law Dimensions of Urban Governance

随着中国城市化进程的不断加快,如何实现良好的城市治理是当前和今后一段时期内的重大课题。本文以法学、政治学、公共管理学为理论背景,提出城市善治的实现需要在法治维度下考察。进一步地,本文系统论述了法治视角下城市善治的重大和基础理论,认为:城市治理目标体系要以物质文明、精神文明、政治文明、社会文明和生态文明为指标;城市治理体系要以权力与权利互动为核心;城市治理态势要以依法治理与保障人权为取向;城市应急管理体制与机制要贯彻法治与人权原则。

As the accelerating of China＇s urbanization process, it is an important issue of how to achieve good urban governance in the current and future period of time. Based on the background of legal science, political science and public management theory, this paper presents that the achievement of good urban governance should inspect under the rule of law dimension. Further, This paper discusses some major and basic theory about good urban governance under the rule of law perspective. We argue that the target system of urban governance should form its index including material civilization, spiritual civilization, political civilization, social civilization and ecological civilization. The power reformation of urban governance should take power and right interaction as its core. The urban governance situation should take governing by law and guaranteeing human rights as its orientation, And the management system and mechanism for urban emergency should carry through the rule of law and human rights principles.
