中国村民自治的宪政思考

Research on Villagers' Self-government of China from the Perspective of Constitutionalism

宪政与村民自治所具备的制度精神和制度原理一致,它们有着几乎相同的价值追求,有着近似一致的精神品格。中国的宪政建设不能忽视农村基层民主宪政,没有农村基层民主宪政化,就不会有整个国家的民主宪政化,村民自治自身具有丰富的法律内涵和宪政精神。中国村民自治的研究应当突破传统思维视角和研究进路,从宪政的角度对村民自治问题进行分析和阐释,揭示村民自治的宪政价值。

Constitutionalism has the same system spirit and institutional principle with villagers＇ self-government. Both of them almost have the same value pursuit and spiritual character.. Furthermore, the Chinese constitutional government construction can not ignore its work in the rural basic level which can realize the democratic constitutionalism throughout China and provide abundant legal connotation and constitutional spirit to the villagers＇ self-government. The Research on Vil- lagers＇ Self-government of China should break the traditional thinking perspective and research route, meanwhile, analyze and interpret the relevant problems of villagers＇ self-government with the purpose of revealing its real value.
