摘要
虚假广告对社会的危害很大。现行广告法中虚假广告的责任主体不包括广告代言人,但广告代言人在广告传播中往往对消费者的选择产生直接或间接的影响,代言人的这种"超脱"身份在法律关系上产生了风险和收益的不平衡,建立代言人法律责任制度具有合理性。代言人应承担特殊的有限责任。
The mendacious advertisement badly harms the society. Current advertisement law has not provided the mendacious advertisement prolocutor's legal liability ; however, prolocutors will directly or indirectly affect the consumers' attitude with their advertisement, and thus the disengaged status of the prolocutor results in imbalance between risk and benefit. It is reasonable to institute the prolocutor's legal liability and the prolocutor shall bear a special limited liability.
