公众参与与环保NGO法律问题研究

The Study of the Juristic Problems on Pubic Participation and Environmental Protection NGO

环境保护公众参与,是指在环境保护领域,任何个人、组织和团体都依法享有保护环境的权利,同时也负有保护环境的义务,有权对环境质量进行监督和参与环境管理。环保NGO作为近年来兴起的环保主体,在实践公众参与制度方面具有举足轻重的地位。分析我国目前公众参与制度的不足之处和环保NGO在推动环保事业,实现公众参与方面的作用,我国应通过立法和完善环保公益诉讼制度来推动公众参与的实现。

The pubic participation of environmental protection means that according to the law, all individuals, organizations and groups have the right as well as shoulder the obligation to protect the environment, have right to supervise on environmental quality and to participate in environmental management. As a rising environmental protection body in recent years, environmental protection NC, O plays an important role in practical environmental protection public participation system. After analyzing the shortages of present public participating system and the functions of environmental protection NGO in promoting environmental protection and realizing public participation, this article gives suggestions on promoting the realization of public participation by perfecting and promoting environmental NGO.
