当前对环境权主体的研究忽略了其作为法律关系的面向,同时混淆了环境权在不同法律部门中的差异,且存在泛道德化的倾向。厘清这些误区后,即可对环境权主体做出正确认识:在公法层面,其权利主体为公民,义务主体则视情形分为国家或者国家与其他公民或组织;在私法层面,其权利义务主体均为自然人和法人及其他组织。

Studies on the subjects of environmental rights nowadays has neglected its content as legal relationships, and confused the differences of environmental rights in different laws, furthermore, it has the trend of pan - moralization. In fact, the real subjects of environmental rights should be： in public law level, the right subjects are citizens and the duty subjects are the governments or other citizens or organizations; in private law level, both the subjects of right and duty are natural persons as well as legal persons and other organizations.
