施工争议评审委员会(DRB)的运作

Operation of Disputes Review Board (DRB) in Construction

DRB（争议评审委员会）作为一种快速、公正和非强制的解决施工争议的手段，近年来在水利水电工程应用得最多。笔者根据长期参加国际工程的招标及合同管理工作的经验，结合参与鲁布革、大亚湾、二滩、小浪底等工程以及参与非洲、孟加拉等国外工程的实践，将DRB的运作经验归纳为：DRB的组织、委员的任命、工地例行考察、听证会、非正式运作、裁决约束力、作用、费用等，分别进行论述。

Abstract: As a quick, fair and non-mandatory means of solving the disputes in construction, DRB has been heing applied frequently in water resources and hydropower projects in recent years. Based on the long-term experience in participating in the hidding andmanagement of contracts for international projects in combination with the practice of Lubuge, Daya Bay, Ertan and Xiaolangdi projects as well as projects in Africa and Bangladesh, the author expounds the experience of operation of DRB which is summed up into organization of DRB, commission of its members, routine inspection of the site, public hearing, unofficial operation, bindingforce of the adjudication, actions and cost
