An Examination of the Nature of the Disabled Sports Rights

残疾人是弱势中的弱势,参加体育活动是法律赋予残疾人的一项基本人权。拟从我国宪法和相关法律法规出发,参考相关国际公约和宣言,分析和研究残疾人体育权利的涵义、定位、特征、法律渊源及内容等问题,为残疾人体育权利的其他研究提供理论支持。

As one of the most disadvantaged group among the disadvantage people, participating in sports for the disabled are legally bestowed the fundamental human rights . This paper, based on the constitution and the related laws and regulations in our country and taking the correlated international conventions and declarations as a reference, analyzes the values, the defi- nition, and the properties of the disabled sports rights, as well as the source of the law and its contents, so as to be theoretically helpful in researching into other aspects of their sports rights.
