论创新与知识产权法制的关系

Relationship between legal system of intellectual property rights and innovation

分析知识产权法制在创新战略中的地位及对创新的作用,指出必须在创新战略的制定和实施过程中,突出知识产权的核心地位,通过制度设计,使创新知识由可共享转化为创新者的私有权利,从而鼓励创新。同时,基于知识产权法制与创新之间的关系,从企业和政府层面提出创新生成的机制,即创新活动应以企业为主体,政府工作的主要方向是为知识产权法制的实施创造适宜的宏观环境。

The paper analyzed the position of legal system of intellectual property fights in the strategy of innovation and its function on innovation. It pointed out that, in the process of formulating and carrying out the strategy of innovation, the nation must give first priority to intellectual property rights, and turn the innovated knowledge from the sharable into the private rights, so as to promote innovation in future. Considering the relation between legal system of intellectual property rights and innovation, the paper brought in a mechanism to generate innovation in the enterprises and the government. It means that the enterprises are to play the leading roles in innovation, and the government＇s function is to create an agreeable macro environmeat for the application of intellectual property rights laws.
