摘要
先进科学技术与传统中药结合应运而生的现代中药,给中国中药产业的发展带来新的历史机遇。结合中国中药法律保护的现状,分析当前现代中药专利保护的困境,指出现代中药本身具有的传统特性、相关制度的缺陷,加之医药企业专利保护意识的淡漠等问题,使得现代中药专利侵权现象十分严重,加强和完善现代中药专利保护制度刻不容缓。
Modem Chinese medicine which is the combination of modern scientific technique and traditional Chinese medicine brings a new history opportunity to the development of Chinese medicine industry. In light of the status of the legal protection of Chinese medicine, the paper analyzed the predicament of the patent protection of modern Chinese medicine, and pointed out that the problems such as traditional characteristics of modern Chinese medicine, the defects of related systems and the indifferent consciousness of medical enterprise make the infringement of modern Chinese medicine very serious, so it brooks no delay to strengthen and improve the patent protection system of modem Chinese medicine.
