传统制造业中的知识产权弱保护状态及其影响--基于长三角地区部分企业的调查分析

Weak intellectual property protection among the traditional manufacturing industry with its effects——ground on the investigation and analysis in the traditional manufacturing industry in Yang Zi Delta

知识溢出对技术进步和社会发展是一把双刃剑,而知识产权适度保护是对知识溢出取利避害的关键。但是实地调查表明,长三角地区传统制造业中的创新成果处于知识产权弱保护状态。这一弱保护状态是由长三角传统制造业的块状分布特点、产业技术特点等共同造成的。知识产权的弱保护状态以及相伴随的知识强溢出,曾经是长三角地区传统制造业快速崛起的重要支持条件。但从我们调查的情况看,它现在已经成为阻碍长三角地区传统制造业创新转轨的重大障碍。

Dozens of problems exist in the innovative achievements＇ intellectual property protection among traditional manufacturing industry in Yang Zi Delta （ namely, Shanghai, Suzhou and Hangzhou areas）. For one, there exists a wide - spread phenomenon of hitchhiking （referring to the practice of imitating other enterprises＇ products） ; second, quite a number of enterprises are reluctant to or lay less importance on the protection of their innovative achievements by means of intellectual property rights system; third, some people act double part in the protection of intellectual property rights. The existence of these problems is not only associated with innovative achievements＇ public goods characteristics, but correlated to the fact that the contents of existed intellectual property protection and traditional manufacturing industry practice are unable to match with their forms, and it also has a bearing up on the absent dissemination of intellectual property ethics. The deficient intellectual property protection has turned out to be a stumbling block retarding the innovation and transformation of traditional manufacturing industry in Yang Zi Delta, which will severely affect the sound and sustainable development of traditional manufacturing industry in China. As a result, intensifying the moral education of intellectual property rights to- gether with supplementing and supporting the intellectual property system with ethical codes will be an important path to improving innovative achievements＇ intellectual property protection in traditional manufacturing industry.
