Of Natural Law Thought and the Evolution in Earlier Modern Times

本文从政治哲学的角度,分析自然法在古希腊政治哲学家的信念中本来是神性之律、理性之律。欧洲中世纪自然法虽然具有新的理论形态,但其基本内容仍步古希腊政治哲学家之后尘。近代早期的自然法逐渐转变为人性之律后,自然法的性质由古希腊的自然义务转向近代早期自然权利,才使自然法具有了真正的实际价值。

This article from angle of political philosophy analyses that the natural law is law of god, law of reason in the faith of ancient Greece political philosopher. Although natural law had the form of new theory at the Middle Ages in the Europe state, its basic content stepped after the political philosopher in ancient Greece. Natural law gradually changed law of humanity in the earlier modern times, property of natural law changed from natural duty to natural right, thus natural law has real practical value.
