摘要
我国民办学校教师法律地位的界定,在与公办学校教师的同等法律地位上虽然在政策文本中获得了肯定,但是在现实的保障与制度履行中却难以达成一致。笔者从民办学校教师法律地位保障的现状入手,在分析传统观念、政策制度及民办教育自身发展等原因后,从自我保障、法律保障、行政保障和社会保障四个维度分别探讨对保障民办学校教师的法律地位的对策。
Although voluntary school teachers occupy the same legal status as their counterparts in the public school,as regulated in policy texts,they actually do not enjoy the same rights.This paper starts from the current unfavorable situations and endeavors to analyze the underlying causes from perspectives of the leg-behind traditional concept,inadequate governmental policy and mechanism,and the school's own inherited disabilities etc.Countermeasures are correspondingly proposed to safeguard the teachers' legal status by means of self-protection,legitimate guarantee,administrative enforcement and social security.
