中西方国家授权立法监控方式之比较研究

Comparative Study on Monitoring Methods to Authorization Legislation of China and Western Countries

授权立法是立法制度的重要组成部分之一,其在解决现代社会所面临的各种复杂问题上发挥了重要作用。但由于授权立法是我国立法制度中的一个新问题,因此在立法实践中难免带有某些不尽人意之处。文章对比分析了中西方国家授权立法的监控方式,并提出了健全授权立法监督机制的构想,以期对我国授权立法制度的完善有所裨益。

Authorization legislation is an important part in legislative system and plays essential role in solving kinds of complex problems that modem society is facing. However it is a new problem in Chinese legislative system, we are still poor in legislative practice more or less. The paper compared and analyzed monitoring methods to authorization legislation of China and western countries, and put forward the thinking of improving supervision mechanism on authorization legislation in order to better our authorization legislation system.
