试论我国刑事诉讼中非法证据排除规则的完善

Improving the Exclusion Rules of Criminal Illegal Evidence in China

非法证据排除规则关系到人权的保障和国家刑事司法权力的规范,是一项十分重要的证据规则。但是,我国仅确立了十分有限的非法证据排除规则,尚未形成完整的法律体系,并且存在着很大的缺陷。应当在修订《刑事诉讼法》的过程中,确立我国的非法证据排除规则,以保障人权和规范刑事司法权力。

The exclusion rule of criminal illegal evidence is a very important rule of evidence. It is related to the protection of human rights and the norm of the state criminal justice powers. However, the rule has just been established in our country, not yet formed a complete legal system, thus with considerable defects. The rule in our country should be established in the process of the revision of ＂The Law of Criminal Procedure＂in order to protect the human rights and the criminal justice authority.
