The Law System and the Economic Basis ——On the Harmonious Uniformity of Internal Structure in Law by Marxism

历史唯物主义法律观认为,法对经济基础的真实反映要求法体系内部结构应当是和谐一致的,不能引起法体系的内在矛盾。而资本主义社会中,始终存在着法的内部结构的和谐一致性要求与法真实反映经济基础的无法克服的矛盾。马克思主义法学对法体系与经济基础二者关系的辩证法理论的剖析,为我国社会主义法制建设提供了宝贵的经验和教训、对我国法律体系的建设与完善有现实的指导作用和意义。

The historical materialism law view holds that,real reflection to the economic basis by the law requests the internal structure of law system must be harmonious by consistent,and should not cause contradictions in the law system.But in capitalist society,contradictions between the request of the internal structure harmonious uniform and the legal reflection of economic basis exist and there is no way to overcome.The diagnostic analysis on the relations between the law system and the economic basis by the Marxism legal science has provided precious reference and the practical significance for the socialism legal system of our country＇s legal framework.
