共有制度作为一种利用效率不是很高的制度,在法律上采取了保障共有随时分割的原则。基于此原则,对按份共有中共有物分割权的性质、共有物的分割方法、共有物分割的效力等问题进行了深入的分析和探讨。

Being as a system the utilization ratio of that is not so high, the common system adopts the principle of guaranteeing the very present division of the common property legally. Based on this principle, this paper makes deep analysis and exploration on the problems such as the nature of the right of the division of mutually-shared property, the methods for the division of the common property, and the validity of the division of the common property, etc.
