摘要
我国物权法中关于建筑物的所有权问题一直是理论界争论的焦点。我国业主建筑物区分所有权制度立法存在以下缺陷:"业主的建筑物区分所有权"的称谓不科学;所有权制度立法的理论基础不统一;所有权编的权利结构不协调。我国有必要制定一部系统的调整建筑物区分所有权的基本规范。
In Reality of Law , the ownership of buildings is always the focus. The present system of building ownership distinction has many shortcomings : Firstly, the name itself is not scientific ; Secondly, the system' s theoretical bases are not united; Thirdly, the right structure is out of line. It is necessary for our country to set down a systematic criterion adjusting building ownership distinction.
