论最高人民法院司法解释的合法性

On the validity of judicial interpretation of the supreme people court

《立法法》中关于法律解释的规定,对最高人民法院发布的司法解释的合法性问题提出了挑战。文章认为《立法法》中的法律解释等同于立法解释,《人民法院组织法》等法律的相关条款为司法解释的合法性提供了法律依据。学界当下的关注点不应再对司法解释的合法性存疑,而应将重心放在如何合法行使司法解释权上。

It is the ＂Le. gislation Law＂ that challenge the validity of judicial interpretation of the Supreme People Court. In fact, the judicial interpretation in legislation law is legislative interpretation and the correlative articles of correlative laws, such as Organic Law of the People＇ s Courts, provide the legal basis for the validity of Judicial Interpretation. The focus of study should be on how to exert the power of the judicial interpretation, not on questioning ist validity.
