The Constitution in 1954 and Modernization of Constitutional Government at Contemporary China:Commemorating the 54th Anniversary of 1954's Constitution

在当代中国宪政现代化的历史上,"五四宪法"无疑具有特殊重要的地位。从法制现代化的分析视角出发,反思"五四宪法"与当代中国宪政制度现代化之间的内在联结关系,分析"五四宪法"得以产生的社会基础,可以概括出"五四宪法"的伟大制度创新及其对当代中国社会主义宪政制度建设的伟大里程碑意义;客观分析出"五四宪法"所存在的制度缺陷及其对当代中国宪政现代化的影响;进而探讨"五四宪法"对于当代中国社会主义宪政国家建设和宪政制度现代化所具有的时代价值。

1954＇ s constitution possesses especially important status in the history of constitutional modernization in China. At the angle of view of modernization of legal system, firstly, this paper rethought the intrinsic relation between 1954＇ s constitution and modernization of constitutional government of our age in China, analyzed the social and cultural foundation of 1954＇ s constitution, and summarized briefly the great institutional innovation of 1954＇ s constitution and its landmark signification for contemporary institutional modernization of constitutional government in socialist China. Secondly, this paper analyzed objectively the institution- al limitation of 1954＇ s constitution and its negative influence on modernization of constitutional government in China. Finally, based o11 above -mentioned facts, this paper probed into practical significance of 1954＇ s constitution for contemporary institutional building of modernization of constitutional government in socialist China.
