竞技体育的刑法基础价值理念探析

竞技体育作为一个商业化极强的社会环节,必然要与法律发生密切接触。然而现实中人们却容易将其脱离于刑法控制之外,把竞技体育当成是独立的自治区域。从竞技体育的法律地位和刑法问题及成因着手,提出竞技体育刑法价值的概念,以刑法理论为基础,结合犯罪学理论,把竞技体育当中可能的犯罪问题统一纳入到一个刑法系统中进行甄别、分析,进行特殊预防控制和一般预防调整。

As an extremely strong social link of commercialization, the competitive sports must keep in touch with the close relation on the legal law. However, people are apt to break away from it on criminal law in reality, and regard it as an independent autonomy area. From the legal status, criminal law problem and origin cause of formation of athletics sports, it put forward the concept of the criminal law value of athletic sports. Based on criminal law theory with the criminology theory, it brought the possible crime problems in athletic sports into a criminal law system and discriminated, analyzed, prevented, controlled and prevented it specially and generally from adjusting in unison.
