中国非物质文化遗产剪纸艺术的知识产权保护

The Intellectual Property Protection of Paper-cut Art in China

传统剪纸是非常优秀的民间艺术,剪纸艺术也是中国的非物质文化遗产.在介绍中国传统剪纸艺术及其目前保护现状的基础上,对其保护的必要性进行了分析,阐述了在知识产权领域内为中国剪纸艺术提供保护的可行性选择,最后针对剪纸艺术在知识产权保护上存在的不足,从中国著作权法、商标法、专利法、反不正当竞争法等现有知识产权各项法律制度以及新兴的域名权保护制度等方面,提出了保护中国剪纸艺术的知识产权保护对策.

Traditional paper-cut is a very outstanding folk art. Based on the introduction of Chinese tradition paper-cut art and current protection status, the article analyzes the necessity of protection, and elaborates the feasible selection of providing the protection for Chinese paper-cut art in the intellectual property fights domain. Finally, aimed at the insufficiency of paper-cut art of the intellectual property protection now, the article proposes some intellectual property protection countermeasures of protecting Chinese paper-cut art in detail in some existing intellectual property rights legal regime, such as copyright law, trademark law, patent law, anti-unfair competition law and some emerging domain name right protection system.
