我国反垄断法适用除外制度评析

Comments on Exception System of Anti-Monopoly Law in China

适用除外制度是反垄断法的重要组成部分。适用除外制度的生成对反垄断法协调垄断和竞争的关系具有特殊的意义。我国反垄断法在借鉴各国经验的基础上规定了符合中国国情的适用除外制度,但我国反垄断法适用除外制度在实体法和程序法上存在不足。对我国反垄断法适用除外制度作出评析并就立法和执法提出若干建议,对于有效地实施反垄断法无疑具有十分重要的意义。

The exception system is an important part of anti-monopoly law. Exception system has special significance in harmonizing monopoly and competition. Anti-monopoly law in China has regulated exception system which caters for special situations in china on the base of other country＇s experiences; however, it has flaws in substantive law and procedure law. In order to administer anti-monopoly law effectively, the paper makes comments on the exception system of our anti-monopoly law and gives some suggestions on legislation and administration of law.
