摘要
《劳动合同法》规定制定劳动规章制度必须由用人单位与工会或者职工代表平等协商确定,即法律规定通过劳资双方谈判制定劳动规章制度是必经程序,而实践中出现谈判僵局不可避免。如何处理谈判僵局,我国现行立法没有规定,理论界目前尚无人讨论。本文对谈判僵局的定义、成因和后果进行了分析,并提出了建立谈判僵局司法救济制度的设想。
Chinese employment contracts law says, whe n an employer formulates internal rules and regula-tions, shall discuss with the employee representative congress or all the employees,whereupon the matter shall be determined through consultations with the Trade union or employee representatives conducted on a basis of equality.But when the negotiations deadlock appear,how to handle? Nobody study it in theory nowa-day.Through analysis its reasons and results, it is proposed that the leagal assistance systems should be constructed.
