摘要
大多数"情况说明"不能成为证明案件事实的证据,"情况说明"不是鉴定结论、书证、勘查检验笔录和犯罪嫌疑人、被告人供述和辩解,少数"情况说明"应归入证人证言,个别的可归入视听资料;一些"情况说明"有其存在的合理原因,能作为证据使用,但应该分门别类地加以规范,大量的"情况说明"没有存在的多大必要,应该严格限制使用。
Most of the ＂situation＇s explanation＂ can＇t be the evidence of the cases, because it＇ s not expert conclusion, documentary evidence, graphology of investigating inspection, and confessions or excuses of criminal suspects or defendants. A few of the ＂situation＇s explanation＂ should fell under witness testimony, some individual ＂situation＇s explanation＂ should fell under audio-visual material, and most of the ＂situation＇s explanation＂ is not necessary, so it should be used strictly.
