检察机关查办农村基层组织人员职务犯罪的法律适用问题研究

On suitable law to use in crimes by taking advantage of duty of rural grassroots

社会主义新农村建设使农村经济生活发生巨变,经济利益的刺激加之立法滞后、监督乏力等原因而引发的农村基层组织人员职务犯罪案件呈现出主观恶性深、后果严重等特点。我们认为,在从源头上遏制和减少涉农职务犯罪中,对法律适用的难点和不统一处作系统的分析与评价是必要且紧迫的。本文正是以此为出发点,在对基层检察机关办案部门进行充分调研的基础上成文。以期对立法及实践有所裨益。

This article is as a starting point in the prosecution case on the grass-roots sector fully on the basis of written research with a view to the benefit of legislation and practice.
