Analysis on the Provision of the Contract Law about Penalty Responsibility

《合同法》第一百一十四条对违约金作了相关规定,但这种规定实际上造成严重的理论认识上的混乱,目前通行的教材和理论专著中对合同法关于违约金的规定所进行的阐述和解释充满了矛盾和对立,本文试着从这一规定入手,谈谈自己的看法。

The article 114 of contract law contains the relevant provisions of penalty, but it caused serious theory confusion. At present, there are so many contradictions and confrontations on the provisions of penalty in those teaching materials and theoretical monograph.The author try to talk about his views towards this provision.
