Legal Design of International Dispute Settlement Mechanism of The China-Kazakstan International Frontier Cooperation

中哈霍尔果斯国际边境合作中心2008年底将正式封关运营,但对中心将来可能发生贸易争端问题尚没有设计出具体的解决方机制。借鉴全球性世界贸易组织和区域性贸易组织争端解决机制的成功经验,以中心争端解决机制的适用范围、基本原则、主体资格、组织机构、决策机制、执行程序和规则解释权限制等法律制度为基础,设计一套符合中心区域贸易安排、适应中亚经贸特色的区域解决机制。

At the end of 2008, The China-Kazakstan Horgos Frontier International Cooperation Center will be shut down operation officially. Its dispute settlement mechanism still has not had the concrete system. Referring to the experience of dispute settlement mechanism between World Trade Organization and Regional Trade Organization, and on basis of the legal regimes such as the application scope, basic principle, subject qualification, organization, decision mechanism, executive routine, regular right to interpret limit, a set of regional solution mechanism is designed to accord with the central region trade arrangement and suit to the economics and trade characteristic of Central Asia.
