《标准施工招标文件》中争议评审条款的研究

The Flaw of Dispute Review Terms in the <Standard Tender Documents for Construction>

FIDIC施工合同条件中DAB和世行推荐的DRB,都是解决建设工程合同纠纷的解决方式。我国将施行的《标准施工招标文件》参照DAB和DRB设置了争议评审条款。该条款却存在一定的缺陷,使得该条款难以得到完美实施。分析了争议评审条款的缺陷,提出了完善争议评审条款的建议。

Both DAB in the FIDIC conditions of contract for construction and DRB commended by World Bank is the way to solve the dispute in connection with the contract for construction. There are certain dispute review terms gone by DAB and DRB in 〈standard tender documents for construction〉 that will be used in China widely. But, the terms are not perfect so that can＇t be used perfectly. The paper analyzed those terms＇ flaw and point out a way to make the terms perfectly .
