有效的激励措施能提高工程建设效率,而合同是激励措施落实的重要手段,因此必须设计准确、合理、完备的激励条款。通过对我国建设工程施工合同示范文本、FIDIC施工合同条件的激励条款进行分析,提出激励条款设计建议。

Effective incentive measures would improve efficiency of construction, and contracts are the important means to put incentive measures into effect. So contracts must be provided with exact, reasonable, self-contained incentive clauses. The paper will analyse the incentive clauses of Contract for Construction, Conditions of Contract for Construction of FIDIC At last the paper will table reasonable proposals to set up incentive clauses.
