摘要
在市场经济条件下,社会用地制度同样应由两部分构成:即公共利益用地制度和非公共利益用地制度。在我国长期的社会发展和经济建设中,公共利益内涵泛化,导致非公共利益用地的取得途径被极大扭曲。文章在提出建立非公共利益用地制度必要性的基础上,分析了构建我国非公共利益用地制度可能引发的农地流转失控、集体土地与国有土地衔接以及土地收益分配等诸多问题,最后对构建我国非公共利益用地制度提出了相关政策建议。
Under the situation of market economy,social land-use system also include two parts,namely public interests and non-public interests.During the long-term social and economic development,owing to the extension of connotation of public interests,the acquisitive approach for land-use for non-public interests is contorted.The paper analyses some problems,such as the conversion of farmland may be out of control;the collective land connects with state-owned land;and the distribution of the income of land.Finally some policy suggestions are offerd.
