Reconstruction of China Factual Marriage System——Protection for Disadvantaged Group of Women and Children

鉴于我国事实婚姻立法现状的不足,我国应立法规范事实婚姻制度,明确事实婚姻当事人之间的权利和义务,建立事实婚姻自动转正制度和婚姻监督制度等,以加强对妇女、儿童权益的保护。

With regard to the shortcomings of China factual marriage legislation, this paper points out the China should make laws to standardize factual marriage system, make clear the rights and obligations between the parties to factual marriage and set up factual marriage automatic formation system and marriage supervisory system as m strengthen the protection for women and children.
