论公民环境权保障机制的缺陷与完善

Defects and Improvements of Protection Mechanisms of Civil Environmental Right

公民环境权是伴随着人类无限改造自然所带来的环境问题而产生的,是现代社会人权的一项基本内容。我国现行法律和政策对公民环境权保障的规定明显滞后,制约了公民环境权的实现。本文从环境权的性质出发,揭示了我国公民环境权保障机制存在的缺陷,并结合我国实际情况深入分析了如何完善我国公民环境权保障机制。

Civil Environmental Right, an essential element of human rights in modern society, is accompanied with environmental problems arising from human unlimited transforming the nature. China＇s existing laws and policies on protection of Civil Environmental Right has lagged far behind the requirements. It restricts the realization of the Civil Environmental Right. Based on the characteristics of the environmental right, this paper reveals the defects of protection mechanism of Civil Environmental Right, and deeply analyzes the ways to improve the protection mechanism of Civil Environmental Right based on China＇s actual situation.
