构建和谐社会,传承中华民族的优良传统,体现了我党在新的历史条件下执政观念和执政方式的重大调整,也将导致刑事司法观念和诉讼模式的重要变革。恢复性司法与构建和谐社会在理念方面有诸多契合之处:其比较全面地照顾到了有关当事各方,有利于建设和平社区;简化了犯罪的处理程序,采取经济的责任形式,大大降低了刑法的成本;有助于实现刑法预防犯罪的目的;有助于实现刑法保障人权的功能。

Constructing harmonious society, inheriting and passing on excellent Chinese nation＇s tradition embody the important regulation of our party＇s ruling conception and mode under the new history situation, will lead to the important transformation of criminal judicature conception and litigation mode. There are many ideal agreements between restorative iustice and constructing harmonious society：restorative justice considers the every relative party involved, it is helpful to build peaceful community;simplifies the punishment procedure for criminal, taking economical responsibility, reduces consumedly the penal cost;is helpful to realize the criminal law＇s purpose of preventing crime; is helpful to realize the criminal law＇s function of protecting human rights.
