网络时代著作权合理使用制度思考

Thinking on the fair use of copyright in the internet environment

作为著作权权利平衡机制的合理使用制度,在网络环境下面临着巨大挑战。我国现行的著作权法对合理使用的规定在网络环境下已显得不尽合理。网络技术的发展不应导致合理使用制度的消失,只是其使用范围应做进一步调整,相关的运行机制和立法规定应进一步完善。

As the right balance machanism for the copyright, the system of fair use is facing a serious crisis in eyberspace. Legal rule of our existing Copyright Law on the fair use is unreasonable. Development of network technology should not cause fair use of the system disappearing , but the range of the fair use in the net environment should be further adjustment, related operational mechanism and legislation should be further improved.
