乡土纠纷解决机制之思考

On Mechanism of Solving Rural Social Disputes

目前,我国乡土纠纷解决机制严重影响了乡土纠纷的顺利解决,究其原因主要是传统因素的影响及诉讼自身的局限性。然而,非诉纠纷解决机制尽管早已为中国乡土社会所接受,但也受到市民社会的影响,其解纷的功能正在日渐削弱,加之其权威性与公正性难免受到质疑。故而,乡土纠纷解决机制宜走多元化道路,应在发挥非诉纠纷解决机制的基础上,吸收诉讼纠纷解决机制的优点。

Our rural society has been deeply influenced by traditional factors for a long time. In addition, the shortage of lawsuit crampt its style in solving the rural disputes. In fact, the disputes in rural society are mostly solved through the non-lawsuit way. So analyzing and perfecting the present mechanism solving the disputes in the rural society has great significance to keep the social stability and promote the development of rural society.
