法官不作为及其应对举措

On the Causes and Elimination of the Nonfeasance of the Judge

法官不作为有拖延办案、发现罪行不移送、不报告、不遵守程序等不同的表现形式。其原因主要是司法腐败,司法权不独立、司法行政化,以及民众的法律意识和法官的专业素质缺乏。要改革目前的法院行政管理模式,法院经费由中央财政统一管理;法官的不作为给当事人造成严重损失时,由法院、法官协会先予赔付当事人,进而再追究法官的相应责任;要加强民众的法律意识,提高法官素质。

The nonfeasance of the judge includes judge＇s delay of a case, not transferring or reporting the crime, neglecting the procedure and so on. The causes of the nonfeasance of the judge is judicial corruption, dependence of jurisdiction, govemmental of justice, and the deficiency of popular legal awareness and spectalization of judge. The current administration of court and centered-funds management must be reformed. Courts or judge association must compensete the litigant before investigating for the judge＇s responsibility when the nonfeasance caused serious demage to the litigant. People＇s legal awareness must be strengthened and the judge＇s quality must be enhanced as well.
