欧盟立法中货物自由流通与文物保护的冲突与协调 被引量：3

摘要 欧盟关于文物出口以及返还从成员国境内非法转移的文物的3911/92条例与93/7/EEC指令的制定过程也是货物自由流通原则与文物返还与保护原则的博弈过程.在文物的保护方面如何为货物的自由流通原则设置例外,使之既能保障贸易自由又可防止文物资源的流失,并非易事。3911/92条例与93/ 7/EEC指令规定的文物出口和返还机制既借鉴了相关国际公约的做法,也具有自己的特色.围绕3911/92条例和93/7/EEC指令的争论表明,为更好地促进欧盟文物资源的保护,欧盟应在发展合法的艺术品和文物贸易与维护成员国保护文化遗产的利益之间找到恰当的平衡点.
